MOTORCYCLE TOUR ON CFMOTO 450 MT

1. Acknowledgment of Risk

I, the undersigned, fully understand that participating in a motorcycle tour with A Different Agenda (ADA) involves inherent risks and hazards. These include, but are not limited to:

Road accidents or collisions
Mechanical failure
Weather-related challenges
Dangerous terrain or road conditions
Health risks, including altitude sickness, dehydration, or fatigue
Political, cultural, or environmental instability
Delays or changes in itinerary due to force majeure

I voluntarily assume all such risks, whether foreseen or unforeseen.

2. Motorcycle Use & Responsibility

I understand that I am solely responsible for the motorcycle assigned to me during the duration of the tour. I agree to:

Operate the motorcycle in a safe, lawful, and responsible manner
Follow all instructions, briefings, and route guidance provided by ADA staff
Refrain from riding under the influence of alcohol, drugs, or medication that may impair my ability
Immediately report any mechanical issues, accidents, or damages to ADA staff

I accept financial responsibility for any loss or damage to the motorcycle caused by my negligence, including:

Collisions or crashes
Water damage
Off-route use
Tampering or unauthorized repairs
Reckless riding

Minor wear and tear (e.g., cosmetic scratches) are acceptable and will be assessed at the company’s discretion.

3. Insurance & Responsibility

I confirm that I have been informed that motorcycle insurance is not available or guaranteed in Pakistan. Therefore:

I accept full responsibility for any damage or loss to the motorcycle I am provided.

I acknowledge that a USD 500 refundable damage deposit is collected prior to the start of the tour.

In the event of damage or loss of parts, the cost of repair or replacement of the damaged part(s) will be deducted from this deposit.
If there is no damage, the full deposit will be refunded at the conclusion of the tour.
In the event of total loss, including but not limited to situations where the motorcycle is rendered beyond repair (e.g., severe crash damage, engine seizure due to misuse, fire, theft, or willful destruction), I agree to compensate A Different Agenda (ADA) the full replacement value of USD 10,000 within 30 days of the incident.
I acknowledge that ADA does not provide third-party liability or personal accident coverage.
I have been advised to secure personal travel insurance that includes motorcycle adventure travel and medical evacuation coverage.

4. Medical Fitness & Personal Responsibility

I affirm that I am in good physical and mental health and capable of participating in this tour.
I confirm that:

I do not suffer from any medical condition that may be aggravated by this activity
I carry any required prescriptions or personal medications with me
I will inform ADA of any health concerns or emergency contacts in advance

5. Release & Waiver of Liability

In consideration of my participation in this tour, I hereby release and discharge:

A Different Agenda (ADA)
Its owners, operators, employees, agents, and affiliated partners from any and all liability, claims, demands, actions, or causes of action whatsoever, including those resulting from negligence, for any injury, illness, loss, damage, or death that may occur as a result of participation in the tour or while using the company’s vehicles or equipment.

This release is binding upon me, my heirs, executors, administrators, and legal representatives.

6. Photo & Media Release (Optional)

I grant ADA permission to use photos and videos taken during the tour that may include my likeness for promotional or commercial purposes, unless I explicitly state otherwise.

7. Governing Law

This agreement shall be governed by and construed in accordance with the laws of Pakistan. Any legal disputes will be subject to the jurisdiction of courts located in Lahore, Pakistan.

Signature & Consent

By booking and participating in this tour, I confirm that I have read, understood, and accepted this Waiver and Release of Liability in full, and that I agree to it voluntarily.
